ACUERDO MULTILATERAL M268
Bajo aplicación de la sección 1.5.1 del Anexo A del ADR, relativo al transporte de embalajes desechados, vacíos, sin limpiar (n.° ONU 3509).
(1) Por derogación del capítulo 2.1, de las secciones 2.2.9, 3.2.1, 7.3.2 y 7.3.3, de la subsección 4.1.1.11, y del párrafo 5.4.1.1.1 del ADR, y de acuerdo con la nueva disposición 663 adoptada por la Reunión Común del Comité de Expertos del RID y del Grupo de trabajo del transporte de mercancías peligrosas durante su sesión de otoño del 2013, los embalajes vacíos sin limpiar que son desechados pueden ser afectados al número ONU 3509 bajo reserva que entren en el marco del siguiente párrafo a), y puedan entonces ser transportados según las disposiciones del siguiente párrafo b):
a) Los embalajes, grandes embalajes y grandes recipientes para granel (GRG) vacíos sin limpiar, o las partes de ellos, transportados para su eliminación, su reciclaje o de la recuperación de su material, y no a los fines de reacondicionamiento, reparación, mantenimiento rutinario, reconstrucción o reutilización, y que han sido vaciados de forma que ya sólo contengan residuos adheridos a los elementos de los embalajes cuando sean presentados al transporte, pueden ser afectados al número ONU 3509 «EMBALAJES DESECHADOS, VACÍOS, SIN LIMPIAR».
Estas mercancías entonces son afectadas a la clase 9, al número de identificación de peligro 90 y a la categoría de transporte 4 (código de restricción en túneles E).
Los residuos presentes en las mercancías del número ONU 3509 sólo pueden ser materias de las clases 3, 4.1, 5.1, 6.1, 8 o 9. Además, no deben tratarse:
• de materias afectadas al grupo de embalaje I o para las cuales «0» figure en la columna (7A) de la tabla A del capítulo 3.2, ni
• de materias clasificadas como materias explosivas desensibilizadas de la clase 3 o 4.1, ni
• de materias clasificadas como materias autorreactivas de la clase 4.1, ni
• de materias que presenten un riesgo de radiactividad, ni
• de amianto (ONU 2212 y ONU 2590), de difenilos policlorados (ONU 2315 y ONU 3432), de difenílos polihalogenados (ONU 3151 y ONU 3152).
b) Disposiciones relativas a la carga:
LOS EMBALAJES DESECHADOS, VACÍOS, SIN LIMPIAR, manchados de residuos que presenten un riesgo principal o subsidiario de la clase 5.1, no deben ser embalados con otros EMBALAJES DESECHADOS, VACÍOS, SIN LIMPIAR ni cargados al mismo tiempo con otros EMBALAJES DESECHADOS, VACÍOS, SIN LIMPIAR en el mismo contenedor, vehículo o contenedor para granel.
Los procedimientos documentados de clasificación deben establecerse en el lugar de la carga a fin de asegurar que las prescripciones aplicables a esta rúbrica se satisfacen.
Disposiciones relativas a la utilización de los embalajes
Los embalajes autorizados para el transporte de mercancías peligrosas del número ONU 3509 son los embalajes, GRG o grandes embalajes que satisfacen respectivamente las instrucciones de embalaje P003 para los embalajes, IBC08 para los GRG, o LP02 para los grandes embalajes. Además, las disposiciones siguientes se aplican:
• Los embalajes, GRG o grandes embalajes no necesitan satisfacer las prescripciones del párrafo 4.1.1.3;
• Conviene utilizar embalajes, GRG o grandes embalajes que satisfagan las prescripciones respectivas de la sección 6.1.4, 6.5.5 o 6.6.4, estancos o dotados de un revestimiento o bolsa cerrada estanca y resistentes a la perforación;
• Cuando los residuos presentes sean sólidos que no peligren con licuarse a las temperaturas susceptibles de ser alcanzadas en el curso del transporte, se puede utilizan los embalajes, GRG o grandes embalajes flexibles. En presencia de residuos líquidos, conviene utilizar embalajes GRG o grandes embalajes rígidos que dispongan de un medio de retención (por ejemplo un material absorbente).
• Antes de ser llenado y presentado al transporte, cada embalaje, GRG o gran embalaje debe estar controlado y reconocido exento de corrosión, de contaminación o de otros defectos. Todo embalaje, GRG o gran embalaje que tengan signos de fragilidad deben dejar de ser utilizados (las pequeñas abolladuras o arañazos no se consideran como fragilidad del embalaje, el GRG o el gran embalaje);
• Los embalajes, RG o grandes embalajes destinados al transporte de EMBALAJES DESECHADOS, VACÍOS, SIN LIMPIAR que contengan residuos de la clase 5.1, deben ser construidos o adaptados de manera que las mercancías no puedan entrar en contacto con la madera u otro material combustible.
Disposiciones relativas al transporte a granel
El transporte a granel de materias del número ONU 3509 está autorizado:
• Bien en contenedores para granel cerrados (código BK2),
• Bien en vehículos cubiertos o en contenedores cerrados (códigos VC2+AP10 que entrarán en vigor el 1 de enero del 2015),
que sean estancos o dotados de un revestimiento o bolsa cerrada estanca y resistentes a la perforación, y provistos de medios que permitan retener todo líquido liberado susceptible de escaparse durante el transporte, por ejemplo un material absorbente.
Además, cuando los contenedores, vehículos o contenedores para granel transporten EMBALAJES DESECHADOS, VACÍOS, SIN LIMPIAR que contengan residuos que presenten un riesgo principal o subsidiario de la clase 5.1, estos contenedores, vehículos o contenedores para granel deben estar construidos o adaptados de manera que las mercancías no puedan entrar en contacto con la madera u otro material combustible.
Disposiciones relativas a la documentación
La designación oficial de transporte que figura en el párrafo 5.4.1.1.1.b) debe ser completada por las palabras «(CON LOS RESIDUOS DE [...])», seguido de la(s) clase(s) y del (los) riesgo(s) subsidiario(s) que corresponde(n) a los residuos concernidos, por orden de numeración de la clase. Además, las disposiciones del párrafo 5.41.1.1.f) no se aplican.
Por ejemplo, los EMBALAJES DESECHADOS, VACÍOS, SIN LIMPIAR que hayan contenido mercancías peligrosas de la clase 4.1, embaladas con los EMBALAJES DESECHADOS, VACÍOS, SIN LIMPIAR que hayan contenido mercancías de la clase 3 que presenten un riesgo subsidiario de la clase 6.1, debe ser designado en la carta de porte como:
«UN 3509 EMBALAJES DESECHADOS, VACÍOS, SIN LIMPIAR (CON RESIDUOS DE 3, 4.1, 6.1), 9.»
(2) Todas las demás disposiciones del ADR son aplicables.
(3) Además de las indicaciones prescritas para el ADR y por el presente acuerdo, el expedidor deberá hace constar en la carta de porte la mención siguiente:
«Transporte autorizado según las condiciones estipuladas en la sección 1.5.1 del ADR (M268).»
(2) Este acuerdo será válido hasta el 31 de diciembre de 2014 para el transporte en aquellos territorios de las partes contratantes del ADR que hayan firmado el presente acuerdo. Si es revocado con anterioridad a esa fecha por alguno de los firmantes, será válido únicamente para el transporte de mercancías en aquellos territorios de las partes contratantes del ADR que no lo hayan revocado.
